If you are attempting to sell your Sorrento South property through a realtor or on your own, it is important for you to know that Florida law requires prospective buyers to be presented a disclosure summary before executing the contract for sale.
This must be in a form similar to that outlined in Chapter 720.401 of the 2008 Florida Statutes. The disclosure explains the fact that the owner is subject to deed restrictions, mandatory association membership, and certain financial obligations. A copy of the current (1997) Covenants should be provided to the prospective buyer. The Sorrento South documents are available on our website. If you do not have a set of documents and do not have computer access, please contact Association secretary Joy Mahler at 966-3628. The Florida Statute form (720.401) can be found at http://leg.state.fl.us/Statutes/. (Click on “Title XL,” then on “Part II” of Chapter 720.) If you have a realtor, he or she should have a pre-printed copy of this form.
We also urge sellers and/or listing agents to contact the Association with information about scheduled closings. Buyers become Association members upon purchase of the property, so we must receive buyer information before or at the time of closing in order to communicate with the new owner regarding membership. Upon request, the Association provides necessary documentation to the title company or closing attorney regarding the membership status of the property and any pending matters of interest to those involved in the sale.
